Formal public consultation on the CRM Functioning Rules

Context

Today, Friday 28 August 2020, Elia launches a formal public consultation of the stakeholders on the Functioning Rules of the Belgian Capacity Remuneration Mechanism (“CRM”) in accordance with Art. 7 undecies §8 of the Electricity Act as inserted by the CRM Act.

This set of Functioning Rules is to be considered as a proposal from Elia submitted for public consultation to the market and has been elaborated based on thorough discussions with CREG and stakeholders in TF CRM design and TF CRM implementation. After the public consultation, a consultation report will be drafted, the Functioning Rules will be updated on the basis of received comments and will be formally submitted for approval to CREG. The formal validation process of this set of Functioning Rules applicable for the Year-4 auction for the delivery period starting November 1st 2025 is foreseen for 2021, with a publication by Elia latest May 15th 2021 according to the CRM Act.

These Functioning Rules describe in a further level of detail the methodologies, rules and principles of the functioning of the CRM without the justification of the choices taken. Justifications have been elaborated in the design notes, consultation reports and the material provided in the context of the Task Force CRM (design and implementation) that are all published on the Elia website . These documents can be considered as non-binding background information.

Period

The stakeholders are kindly requested to provide their comments and suggestions within four weeks after the launch of the consultation. The feedback is hence expected at the latest by Friday 25 September 2020 at 6 pm.

The reactions can be provided to Elia via the form below, where you can indicate the level of confidentiality. It is important to know that Elia will consolidate the different remarks and publish them on its website at the end of the consultation unless the respondent requests confidentiality in its response. Please note that all received feedback (also the confidential ones) will be shared with the members of the CRM Follow-up Committee (“Comité de Suivi”) consisting of representatives from the Federal Public Service Economy-DG Energy, the federal regulator CREG, the office of Federal Energy Minister Marghem and Elia, unless the stakeholder explicitly indicates that this is not allowed.
