Public consultation on the Proposal for Amendments to the Terms & Conditions for Balance Responsible Parties (T&C BRP)

Elia is organising a public consultation on the Proposal for Amendments to the Terms & Conditions for Balance Responsible Parties (hereafter “T&C BRP”). The Proposal for Amendments to the T&C BRP consists of amendments relative to:
- the BRP balancing perimeter correction in context of flexible connection agreements; and
- faster settlement of imbalance invoices and related update of the financial guarantees in function of this faster settlement, as described in the 2024 CREG incentive BRP faster settlement; and
- the invoicing process; and
- the digital update of the contact details for the BRP.
Context
In the context of an expected increase in congestion issues, the framework for flexible connection agreements is evolving. The design evolutions on the framework for flexible connection agreements were described in a design note found on the Elia website
(Connection with flexible access: Design note on the evolution of the framework at federal level). This part of the T&C BRP refers to the Connection Contract, where the modalities and volume to be used to correct the BRP balancing perimeter will be described in a next revision in 2026, and will consequently only be applicable when this revised Connection Contract enters into force.
In 2024, Elia performed the incentive on BRP Faster Settlement. The full details in scope of this incentive can be found in the design note published at the time on the Elia website (Design note on the BRP Faster Settlement). The design is implemented almost entirely as presented within the incentive, although certain aspects have been finetuned, as described in the explanatory note.
Amendments relative to the invoicing process are introduced to precise that, pursuant to the Royal Decree of 8 July 2025, only structured electronic invoices will be sent and received via the Peppol network from 1st January 2026, if applicable. Moreover, in order to streamline the invoicing process, Elia proposes to consider electronic invoices to be received on the day they are sent, and that invoice regularization is performed on a monthly basis in month M + 6 for a certain month M, rather than on a yearly basis.
With the development of the EPIC digital customer portal, BRPs will be able to update their list of contacts through the EPIC portal, instead of by exchanging documents with Elia. In addition, Elia proposes to update the list of roles to include in the contact details list.
Period
Elia invites all stakeholders to submit any comments and suggestions they may have on the document submitted for consultation.
The consultation period runs from 3rd September 2025 to 3rd October 2025 included.
After the consultation period, Elia collects all comments and feedback from the market parties. Elia will analyse these comments and integrate them into a consultation report together with Elia’s responses. In addition to the consultation report, Elia will publish the reactions of the market parties (including names) on the website, unless it is explicitly stated that the contribution is to be considered confidential.
