Public consultation on Elia's proposal to unilaterally terminate the appointment as access holder and/or balancing responsible party

Elia is organising a public consultation on its proposal to unilaterally terminate the appointment as access holder and/or balancing responsible party in accordance with Article 198 of the Federal Grid Code.
De note submitted for consultation has already been discussed informally with the marker parties at various meetings of the Belgian Grid Working Group.
Context
Pursuant to Article 198 of the Federal Grid Code (FGC) of 22 April 2019, Elia has the obligation to elaborate a procedure for the unilateral termination of the designation as access holder and/or balancing responsible party within 12 months of the publication of the FGC. This unilateral termination procedure is better known as the drop-off procedure.
The proposed procedure developed by Elia is based on the obligation as defined in the FGC and strikes the right balance between the different positions and interests of all market players.
It is important to note that this liability is only included in the FGC. Such obligation is currently not provided for in the Technical Regulations at regional level, which implies that the drop-off procedure can only apply to grid users connected at federal level.
The subject of this public consultation concerns the proposal of the drop-off procedure (and the principles on which it is based) and how this procedure can be integrated into the Access Contract in a second phase, which will be reviewed in the second half of 2020.
Period
Elia invites all stakeholders to submit any comments and suggestions they may have on the document submitted for consultation.
The consultation period runs from 10 June to 10 July 2020.
After the consultation period, Elia collects all comments and feedback from the market parties. Elia will analyse these comments and integrate them into a consultation report together with Elia’s responses. In addition to the consultation report, Elia will publish the reactions of the market parties (including names) on the website, unless it is explicitly stated that the contribution is to be considered confidential.
